WDC BJJ Liability Waiver
Read · Complete · SignWaiver of Liability, Assumption of Risk, Indemnification, and Medical Authorization
This Waiver of Liability, Assumption of Risk, Indemnification, and Medical Authorization (this “Waiver”) is entered into with WDC Brazilian Jiu Jitsu LLC, doing business as WDC BJJ and GFTeam DC (the “Academy”), located at 720 Erie Ave, Takoma Park, MD 20912 and 4616 Ingraham St, Hyattsville, MD 20781. “Participant” means the person who will take part in Academy activities; “Signer” means the Participant, if 18 years of age or older, or the Participant’s parent or legal guardian.
1. Activities Covered
This Waiver applies to all Academy activities, at either Academy location and at any off-site Academy event, including Brazilian Jiu-Jitsu and grappling instruction, classes, drills, live sparring (“rolling”), open mat sessions, private lessons, youth programs and camps, seminars, competitions and competition preparation, and any related physical training (collectively, the “Activities”).
2. Assumption of Risk
The Signer understands that Brazilian Jiu-Jitsu is a full-contact martial art involving throws, takedowns, joint locks, chokes and strangles, pins, and close physical contact with other participants, and that the Activities involve inherent risks that cannot be eliminated regardless of the care taken. These risks include, without limitation: bruises, cuts, mat burns, sprains, strains, dislocations, fractures, dental and eye injuries, concussions and other head injuries, injuries to the neck and spine, communicable illness (including skin infections and respiratory illness), and, in rare cases, permanent disability or death. The Signer knowingly and voluntarily assumes all such risks, both known and unknown, arising from the Participant’s participation in the Activities, even if arising from the negligence of the Released Parties (as defined below), and assumes full responsibility for the Participant’s participation.
3. Release of Liability and Covenant Not to Sue
To the fullest extent permitted by the laws of the State of Maryland, the Signer, on behalf of the Signer, the Participant, and their respective heirs, executors, administrators, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue WDC Brazilian Jiu Jitsu LLC, its owners, members, managers, instructors, coaches, employees, contractors, volunteers, agents, and affiliates (collectively, the “Released Parties”) from and against any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, sustained in connection with the Participant’s participation in the Activities or presence at an Academy location, whether caused by the ordinary negligence of the Released Parties or otherwise. Nothing in this Waiver releases any Released Party from liability for gross negligence or willful or intentional misconduct, to the extent such a release is prohibited by law.
4. Indemnification and Hold Harmless
The Signer agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) the Participant’s participation in the Activities; (b) any breach of this Waiver or of Academy rules by the Signer or the Participant; and (c) any claim brought by or on behalf of the Participant, the Signer, or their family members arising from the Participant’s participation. This indemnification obligation applies to the fullest extent permitted by Maryland law.
5. Health, Fitness, and Academy Rules
The Signer represents that the Participant is physically and medically able to participate in the Activities, and agrees to disclose to the Academy, in the form below or directly to an instructor, any medical condition, injury, medication, or limitation that could affect safe participation. The Signer agrees that the Participant will: follow all Academy rules and the directions of instructors at all times; stop training and notify an instructor immediately upon any injury, dizziness, or distress; maintain proper hygiene, including a clean uniform, trimmed nails, and no jewelry during training; and not train while suffering from any contagious illness or skin condition. The Academy may, in its sole discretion, decline or discontinue the Participant’s participation for safety or rule violations.
6. Medical Consent and Authorization
In the event of an injury or medical emergency, the Signer authorizes the Academy and its staff to administer basic first aid and, if deemed necessary, to contact emergency medical services and to arrange emergency transport and treatment of the Participant. The Signer authorizes any licensed medical provider to render emergency care and authorizes the Academy to share relevant information, including the emergency contact and health information provided under this Waiver, with emergency and medical personnel. The Signer understands and agrees that the Signer is financially responsible for all costs of medical care and transport, that the Academy does not provide medical or accident insurance covering the Participant, and that the Participant’s own health insurance, if any, is the primary coverage.
7. Photo, Video, and Media Release
The Signer grants the Academy permission to photograph, film, and record the Participant during the Activities and to use the Participant’s image, likeness, and voice in photographs, video, and audio for the Academy’s legitimate business purposes, including its website, social media, and printed materials, without compensation. The Signer may revoke this permission for future uses at any time by written notice to the Academy.
8. Participants Under 18
If the Participant is under 18 years of age, the Signer represents and warrants that the Signer is the Participant’s parent or legal guardian, with full legal authority to enter into this Waiver on the Participant’s behalf. The Signer agrees that this Waiver binds the Participant and the Signer to the fullest extent permitted by Maryland law, and agrees to indemnify the Released Parties as provided in Section 4 against any claim brought by or on behalf of the minor Participant.
9. Electronic Signature
The Signer consents to sign this Waiver electronically. The Signer’s typed name in the signature field below is the Signer’s electronic signature and has the same legal effect as a handwritten signature under the Maryland Uniform Electronic Transactions Act.
10. General Provisions
Severability. If any provision of this Waiver is held invalid or unenforceable, that provision will be reformed to the minimum extent necessary to make it enforceable, or, if reformation is not possible, severed, and the remaining provisions will continue in full force and effect. Entire agreement. This Waiver is the entire agreement between the Signer and the Academy concerning the matters it covers and supersedes any prior oral or written understanding concerning those matters; it may be amended only in a writing signed by the Academy. Governing law and venue. This Waiver is governed by the laws of the State of Maryland, and any proceeding arising from it will be brought exclusively in the state or federal courts located in Montgomery County, Maryland. Binding effect. This Waiver is binding upon the Signer, the Participant, and their heirs, executors, administrators, personal representatives, and assigns.
